Estate Planning

The Affinity Law Group offers experienced, personalized estate planning services for our clients.  Our areas of representation include:

  • Revocable Living Trusts: Living trusts allow you to avoid probate, and the time delays, significant expense and lack of privacy associated with the probate process. We prepare living trusts and the deeds and related documents required to transfer our clients' interests in real property into the trust.  We also advise our clients on how to properly fund their trusts with their bank accounts, stocks, and other assets in other to avoid the need for a probate administration on the death of a client. 
  • Wills: We prepare simple wills for clients, as well as pour-over wills, which are wills which are designed to work in unison with a living trust. We also prepare wills with guardianship provisions for our clients' minor children.
  • Financial Powers of Attorney: We prepare durable financial powers of attorney for our clients.  This document allows a client to designate a person or persons to manage their financial affairs in the event they become incapacitated.
  • Advance Health Care Directives: We prepare advance health care directives for our clients.  This document allows a client to designate a person or persons to make medical decisions on their behalf in the event they are unable to express their wishes with regard to health care.

Planning for Families with Young Children

We frequently assist young families with children with their estate planning needs, including preparing wills with guardianship provisions for their minor children, and drafting trusts with special provisions for the benefit of their children. 

Planning for the Elderly/Incapacity

Many of our clients are elderly, and are concerned not only about passing their estates to their loved ones without the need for probate, but are also concerned about the possibility of incapacity.  A comprehensive estate plan takes into consideration the possibility of a client's subsequent incapacity.  Well-drafted trusts, durable powers of attorney and advance medical directives serve to protect our clients against subsequent incapacity.

Probate Administration

Probate administration is the process where a court oversees the administration of a deceased person's estate.  We represent our clients in informal and supervised probate proceedings and also provide advice and counsel regarding the administration of small estates with assets of less than $100,000.
